RBPA Terms and Conditions

General Terms

By joining the Recreational Backcountry Pilots Association (RBPA), you agree with the following terms, conditions, and the following section containing our waiver of liability:

Membership Non-transferrable
Your membership to the Recreational Backcountry Pilots Association (RBPA) only applies to the named individual who joins the RBPA and holds a current member's account with RBPA. RBPA membership is non-transferrable. You agree not to loan RBPA membership cards or share login details.
Membership Limits
Membership privileges can only be exercised by the named individual, when operating a fixed wing aircraft as Pilot In Command, when all membership subscription fees are paid in full.
Rules for Members
You agree to operate your aircraft in accordance with the RBPA Concession and in accordance with the RBPA "rules" which are expressed in the 'Understanding Our Concession' page in the members section of this website.
Your Privacy
You agree that the RBPA will share your membership details with the Department of Conservation (DOC) annually. We may also share your details with DOC at any time, without prior notice, if a specific request is received from DOC.
Your Details
You agree to record your aircraft registration(s) and your contact details in the members section of our website. You agree to keep these details updated, when things change.
Cancellation
You agree that the RBPA may cancel your membership at it's sole discretion and without notice, acting in accordance with the RBPA Constitution.
Pilot Currency
You agree that when acting as Pilot-In-Command (PIC), your pilot's license and medical certificate will be current and correct for the aircraft you are operating. You agree to operate within any limitations, restrictions, or privileges relating to the license you hold.
Accidents
You agree to report any accidents or incidents which occur while operating under the RBPA concession to an RBPA Committee member at the earliest opportunity.
Pilot Responsibility
You acknowledge that, as PIC, you are solely responsible for obtaining any required permission to land and for assessing the safety and suitability of each landing, considering the aircraft, conditions, and your skill and experience. You agree not to hold RBPA liable for any accidents, damage, property loss, injury, or death arising from backcountry operations.

By joining RBPA, you agree to the following terms:

Personal Responsibility

You, as Pilot in Command (PIC), are solely responsible for obtaining any required permission to land and for assessing the safety and suitability of each landing, taking into account your aircraft, the conditions, and your skill and experience. You are also solely responsible for the airworthiness, maintenance, and proper operation of your aircraft and equipment.
Assumption of Risk

You acknowledge that backcountry aviation involves inherent risks, including accidents, injury, death, and damage to property or the environment. You agree to accept all such risks while operating under the RBPA Concession.
Release and Waiver

You release RBPA and its Officers from any and all claims, demands, or liability arising from your activities under the RBPA Concession, including claims arising from negligence, errors, or omissions by RBPA or its Officers.
Indemnity

You agree to indemnify and hold harmless RBPA and its Officers from any claims, losses, liabilities, costs, or expenses:
- Suffered by you or your dependents, including harm, injury, or death;
- Brought by any third party arising from your activities under the RBPA Concession;
- Resulting from any damage to land, property, or the environment, or harm to or disruption of animals, while operating under the RBPA Concession.
Emergency and Rescue Costs

You accept full responsibility for any costs associated with search, rescue, or medical assistance that may be required while operating under the RBPA Concession.
Governing Law

This agreement is governed by the laws of New Zealand. You agree that any dispute relating to this agreement will be subject to the exclusive jurisdiction of the New Zealand courts.
